The Directorate of Criminal Investigations (DCI) has been involved in a controversial land dispute in Lavington, Nairobi, that has attracted public attention and criticism.
The DCI arrested an elderly couple, Mahesh Kumar Bhatti and Anita Bhatti, who claimed to own a parcel of land in Lavington that was also claimed by Munir Ahmed Chaundri, a 75-year-old who lives in the United Kingdom.
The DCI alleged that the couple had forcefully detained the land from Chaundri, who had bought it in 1977 and sold part of it to them in 1987ยน. The DCI also recommended that the Ministry of Lands revoke the title deed held by Nairobi House Limited, a company that was in a separate dispute with Lennah Koinange, daughter of former Cabinet Minister Mbiyu Koinange, over another piece of land in Lavington valued at Sh2.4 billion.
However, the DCI's actions were challenged in court by the affected parties, who accused the DCI of violating their rights and acting in bad faith. A Nairobi court quashed the DCI's recommendation to revoke Nairobi House Limited's title, ruling that it was irrational and premature since the dispute was still pending determination.
Another court ordered the DCI to release the elderly couple on bail pending their trial. The DCI defended its investigations and said it would present the facts and evidence before court.
